You Will Never Have Your Fillmore



Hahahhahahah remember just last week when you thought the Fillmore was a done deal after the project was approved by the county planning board? Don't be so naive. Now IMP (the 9:30 Club) is suing the county to stop it:

The lawsuit against the state, filed this week in Anne Arundel County Circuit Court by the club's parent company, IMP Inc., and that company's co-owner Seth Hurwitz, challenges the state subsidy for the project; Montgomery County is also spending $4 million in county funds. The suit says state officials would be breaking the law by paying the subsidy because Montgomery has provided only "skimpy" information about the project's costs, despite requirements by the General Assembly for more information.

Seth is a such little bitch! I can't wait until he loses his monopoly and Live Nation runs him out of business. He has no problem getting money from the state for MW Post... Boycott the 9:30 club!!!

This lawsuit should be dismissed. If it were this easy to challenge how the government spends money, then there would be endless litigation by disgruntled taxpayers. For the legal types out there, I would think that the doctrine of standing would get this case tossed.

Horowitz is a putz. He's trying to screw things up for Silver Spring cause he want's all the action for himself. Keep you're 9:30 and leave others to their own.

On a real note, I don't think MC is going to let this frivolous law suit derail this, too many peaople invested.

You might want to look deeper into this... the Live Nation people who are interested in developing the Fillmore - http://en.wikipedia.org/wiki/Live_Nation - are the real monopolizers in my eyes. They manage artists, have a recording label, a booking agency, several live venues, and they're merging with Ticketmaster. So from the money in your pocket to the music coming out of the artist, they control the entire process.

Personally I'm a big fan of what Seth is doing for independent music.

I also wonder about Hurwitz' standing to sue (being a sore loser usually doesn't count).

Maybe Live Nation is a big bad corporation, as DCGrrl says, but Hurwitz is being a dick.

If I were Hurwitz, I'd use every last tool in my bag to keep Live Nation and Ticketmaster out of the neighborhood. (Leg to stand on or not.)

What would happen if the owner of Black Cat bought the former JC Penney site? Would Seth still sue the county even though the purchaser would be a local independent business man just like himself?

Did the 9:30 Club get any incentives from the DC government when it relocated to the V Street location back in the 1990s? If so, then we have a "Pot Meet Kettle" hypocrisy here.

The bottom line is that Seth rules the current music scene in DC and that is going to come to an end. Let him fight it out with the Black Cat for indy bands and maybe he can bring back raves for extra income. (That's what was in his current location on Vst before he moved in.) I am glad that SS will be the new location for great bands. I am sure it will be cleaner and safer than Seth's 9:30 club. I actually like the 9:30 club as well as the Black Cat and would be ecstatic if Live Nation brought indie music to Silver Spring--not sure if they will though... In any case, it does seem sort hypocritical for Seth to sue...

In the time that they've been fighting over all this, we've hit a recession and the County and State no longer have the money to spend that they once did. I'm afraid that when this finally gels that there won't be any money to pay for it.

I've given up arguing on this one. I will say that "Seth the putz" poster implying that the 9:30 club is unsafe or unclean is off his rocker. The 9:30 club is consistently one of the best-run venues in the country. Low ticket brokerage fees, excellent location and space, (relatively) friendly staff, and consistently great lineup.

BTW, love that the grassroots Facebook 9:30 boycott page is home to Ida Ruben, Bruce Lee, and the page creators' wife. Taking the world by storm!

David Giacomin ...... chill man. Pitching fits about 9:30 and its employees all over just makes them sound like a real threat. Like it or not, 9:30's rep is solid. A dude talking smack on the internet is not gonna bust it. Fillmore needs to build its rep. People have to think it's cool on its own or it’s not gonna work. Instead of freakin about 9:30, focus on that.
